High Court Denies Ritika Malu’s Request for Anticipatory Bail in Mercedes Crash Case

The Nagpur Bench of the Bombay High Court upheld the District and Sessions Court’s decision to deny anticipatory bail to Ritika, also known as Ritu Malu. Malu is accused of driving the Mercedes involved in a fatal crash on Ram Jhula, resulting in the deaths of two individuals on February 25 of this year. Following the denial of pre-arrest bail by District and Sessions Judge R.S. Bhosle (Patil), Malu sought anticipatory bail from the High Court.It is important to note that in the early hours of February 25, a speeding Mercedes driven by Malu was involved in a fatal crash that claimed the lives of Mohammad Hussain Gulam Mustafa (34), a resident of Mominpura, and Mohammad Atif (32), a resident of Jafar Nagar.
Allegedly under the influence of alcohol, Malu fled the scene with Madhuri Shishir Sarda (37) but later surrendered and was subsequently arrested.Initially, charges were filed under Section 304(a) of the IPC and Section 184 of the Motor Vehicles Act, both of which are bailable offenses. At that stage, Malu was granted bail by the JMFC court.However, upon receiving the blood sample report confirming Malu’s intoxication, the police added the more serious charge under Section 304 of the IPC. Subsequently, the police sought her custody from the JMFC, which was denied. Malu’s application for anticipatory bail in this non-bailable offense was then rejected by the District and Sessions Court. Upholding the same, the HC has also denied anticipatory bail to Malu.
The Nagpur Bench of the Bombay High Court has upheld the decision of the District and Sessions Court, denying anticipatory bail to Ritika alias Ritu Malu. Malu is accused of driving a Mercedes involved in a fatal crash that resulted in the deaths of two people. She had applied for anticipatory bail after being denied pre-arrest bail by the District and Sessions Judge. The High Court has also denied her anticipatory bail.
